Terms & Conditions For Easy Mail Use

These conditions represent the terms and conditions for using
the ChristianWebServices email service. The Service is
provided to you on the basis that you accept the terms of this
contract and that you have paid the subscription. It is a
legal agreement and it sets out your rights and obligations
and those of ChristianWebServices . By completing the
registration process and clicking the 'enter' button you are
confirming your agreement to be bound by these terms and
conditions.
These Terms and Conditions supersedes all previous Terms
and Conditions
1.Description of the Service
ChristianWebServices provides a range of domain names which
gives you the ability to create your own email address
("address") (e.g. nickname@domainname.co.uk) using a nickname
and domain name of your choice to send and receive electronic
mail ("email") using the World Wide Web and
ChristianWebServices's own system. You are responsible for
providing and paying for your own access to the World Wide Web
and paying for any telephone and connection charges associated
with such access.
2. Payment
You must pay the subscription fee in advance for the relevant
time period you wish to subscribe for in accordance with the
Subscription Plan notified to you at the time of registration.
The method and amount of payment for the Subscription may be
varied at the sole discretion of ChristianWebServices. Full
details of the charges are listed in our Charging Schedule.
Currently, you may use the following payment methods:
(a) Paypal
(b) Cheque / Postal Order
For Annual Subscriptions (365 days)
- Credit / Debit Card - You may use our credit card or
debit card online facility which operates transactions via a
secure server. We accept the following cards: Delta,
Mastercard, Maestro (previously Switch), Solo and Visa. All
transactions are subject to validation checks. The Annual
Fee will be notified to you at the time of registration. The
charge will appear on your monthly credit card bill or bank
statement. The Fee will be automatically billed against the
credit/debit card number that you provide in the
registration form. You will receive confirmation by email
that we have debited your credit/debit card via our online
facility (Nochex).
- Cheque / Postal Order – Payments made via this method
have to be received within 10 working days or further
renewal reminders will be sent, until either payment is
received or the account is suspended. Payments will need to
be made payable to ‘ChristianWebServices’.
Subject to cancellation in accordance with this Agreement all
Fees and payments are non-refundable. ChristianWebServices
reserves the right to change the Subscription Fees at any time
or to add new fees or charges, on giving you reasonable
notice. Full details will always be available in the Charging
Schedule.
Failure to pay
If payment by you, the user, is rejected, dishonoured or
returned or in the respect of a Direct Debit, incur a
recharge, we reserve the right to suspend the service until
payment is received and to charge an administration fee as
detailed in our Charging Schedule. In these circumstances you
will be sent an email giving you 10 days in which to arrange
for your account to be paid in full.
If, in response to our email, you provide us with valid
payment details so as to enable us to collect the sums due on
your account, we will re-apply for payment. If payment is
still rejected or returned you will be charged a further
administration fee and the service will remain suspended until
the cleared funds are received in full.
Renewals
We will contact you via email in the month prior to your
subscription being due. Once we have received full payment
your subscription will be renewed for 365 days from the
subscription due date. If you do not renew your subscription
within the given time period your account will automatically
be suspended and then deleted after 60 days if payment is not
received. The payment will not be deemed to be received until
cleared funds are in the bank account of ChristianWebServices
If the account is terminated for non payment then all of your
email and stored files will be deleted. ChristianWebServices
shall have no obligation to maintain any content in your
account or to forward any unread or unsent messages to you or
any third party.
New subscription
The Consumer Protection (Distance Selling) Regulations 2000
entitles you to cancel your Subscription should you change
your mind. Your right to cancel must be exercised within seven
working days of the date upon which you subscribed to the
Service. However, you will only be entitled to cancel your
subscription if you have not used the Service. Your right to
cancel therefore expires as soon as you either send or receive
an email (from any third party) via the Service. In the event
that you do wish to cancel you should notify us in writing by
email at cancelservice@ChristianWebServices.
3. The Provision of the Service
ChristianWebServices will allow each user to register a
nickname of their choice under any available domain names up
to a limit of 5 addresses, although no user has exclusive
rights over any domain name which remains the property of
ChristianWebServices. ChristianWebServices reserves the right
to withdraw any of it domain names without warning. However,
we will always endeavor to give the user at least 2 days
notice on any such withdrawal. Each user agrees to provide
accurate, current and complete information in the registration
process and to maintain and update the information. Each user
grants ChristianWebServices the right to disclose to third
parties certain information provided by the user, subject to
ChristianWebServices's Privacy Promise. If any information
provided by the user is false or inaccurate,
ChristianWebServices retains the right to terminate the user's
membership and rights to use the Service.
4. Use of the Service
Each user's right to use the Service is personal to that user
and no user may resell or make any commercial or business use
of the Service (without the express prior consent of
ChristianWebServices). In particular no user should abuse the
Service or use it for any illegal purpose. The definition of
abuse is at the sole discretion of ChristianWebServices (see
clause 4.1). ChristianWebServices may insert its own unique
identifying number into every email header. In return for the
use of the Service each user agrees to follow the logout
procedure at the end of every session.
4.1. Abuse of ChristianWebServices service
ChristianWebServices will take seriously any claims received
advising of a user misusing using the service, (including
spamming/harassment or sending illegal material or
operations). If such a report is received the claims will be
investigated and your account maybe suspended whilst this
takes place. If the claims are found to be incorrect and your
account has been suspended your account will be reactivated
and extended for the period while your account was not active.
If the claim is found to be correct your account will remain
closed and no refund will be issued and information will be
provided to the appropriate authorities if required.
5. Member password and security?
Each user will receive a password on registering for the
Service. It is each user's responsibility to maintain the
confidentiality of that password and is entirely responsible
for any activity which takes place under any of the addresses
registered in their name. If any user becomes aware of any
unauthorised use of any of its registered names and addresses
or any breach of security that user should notify
ChristianWebServices immediately.
ChristianWebServices will not be held responsible for any loss
of emails, information or business of the user should the
provision of the service be temporarily or permanently
withheld for the user for what so ever reason, either with or
outside the control of ChristianWebServices.
6. Third parties
Certain links on the Service lead to websites located on
servers maintained by independent third parties over whom
ChristianWebServices has no control. Accordingly
ChristianWebServices cannot accept any responsibility or
liability for any of the material contained on those websites;
nor does ChristianWebServices accept responsibility for the
availability of those websites. You accept that you are solely
responsible for evaluating any goods or services offered by us
or by third parties via the Service and that
ChristianWebServices will not be party to or in any way
responsible for any transactions between you and third
parties. Where the Service contains advertising and other
material submitted to us by third parties please note that
those advertisers are responsible for ensuring that material
submitted for inclusion on the Service complies with all legal
requirements. ChristianWebServices does not accept liability
in respect of any such advertisements.
7. Intellectual property rights
All the domain names available for use on the Service are the
sole property of ChristianWebServices and should not be used
for any commercial use without the express consent of
ChristianWebServices. Each user acknowledges that the content
of the ChristianWebServices site which includes but is not
limited to text, software, and graphics is protected by
copyright and users are not entitled to copy or reproduce or
distribute any of the content without the express permission
of ChristianWebServices. Each user acknowledges that in
addition to copyright, there are also trademarks and other
intellectual property rights in and relating to the Service
which are owned by ChristianWebServices and which are not to
be used without express permission.
8. Disclaimer of warranties
Due to the multi-party nature of the web, ChristianWebServices
cannot guarantee that the Service will meet any particular
requirements to the users or that the Service will be
uninterrupted or error free or that emails or text messages
will be sent or received within any particular time.
ChristianWebServices does not give any guarantee in respect of
any goods or services purchased or obtained through the
Service or any transaction entered into through the Service.
ChristianWebServices may terminate your access to any part or
all of the Service and any related service(s) at any time,
with or without cause, with or without notice, effective
immediately for any reason whatsoever. ChristianWebServices
may also terminate or suspend your account for inactivity,
which is defined as failing to sign-in to the Service for an
extended period of time, as determined by ChristianWebServices.
If the account is terminated for inactivity then all of your
email and stored files will be deleted. ChristianWebServices
shall have no obligation to maintain any content in your
account or to forward any unread or unsent messages to you or
any third party.
9. Limitation of liability
Each user agrees that he or she uses the Service at their own
risk. ChristianWebServices will not accept any liability
either in contract, tort (including negligence) or otherwise
for any direct, indirect, incidental or consequential loss
resulting from the use or the inability to use the Service.
Nothing in these terms and conditions limits
ChristianWebServices's liability for death or personal injury
resulting from ChristianWebServices's negligence. Each user
agrees that any material and/or data downloaded by a user is
done so entirely at their own risk and each user will be
solely responsible for the consequences of downloading any
such material.
10. Indemnity
Each user agrees to indemnify ChristianWebServices against all
liabilities, claims and expenses that may arise from any
breach by the user of these terms and conditions and any
liabilities claims and expenses incurred by
ChristianWebServices in connection with any claim, action or
proceeding brought by a third party as a result of the user's
use of the Service.
11. Severability
If any of the provisions of this contract is judged to be
illegal, unreasonable or unenforceable the rest of these terms
and conditions will continue to apply. Any delay on the part
of ChristianWebServices to enforce its rights under this
contract will not prejudice or restrict its rights and no
waiver of any such rights will be deemed to be a waiver of any
other right or of any later breach.
12. Notices
Any notices sent pursuant to this agreement will be effective
if sent by email to the user's primary ChristianWebServices
email address 24 hours from the time of sending.
13. Applicable law
These terms and conditions will be governed in accordance with
the laws of England and Wales. Each user and
ChristianWebServices agrees to submit to the exclusive
jurisdiction of the courts of England and Wales.
